فَإِنْ عُثِرَ عَلَىٰ أَنَّهُمَا اسْتَحَقَّا إِثْمًا فَآخَرَانِ يَقُومَانِ مَقَامَهُمَا مِنَ الَّذِينَ اسْتَحَقَّ عَلَيْهِمُ الْأَوْلَيَانِ فَيُقْسِمَانِ بِاللَّهِ لَشَهَادَتُنَا أَحَقُّ مِنْ شَهَادَتِهِمَا وَمَا اعْتَدَيْنَا إِنَّا إِذًا لَمِنَ الظَّالِمِينَ

Sahih International


(5:107) But if it is found that those two were guilty of perjury, let two others stand in their place [who are] foremost [in claim] from those who have a lawful right. And let them swear by Allah, "Our testimony is truer than their testimony, and we have not transgressed. Indeed, we would then be of the wrongdoers."

(5:107) If then it gets known that these two had been guilty of sin, let two others stand forth in their places, nearest in kin from among those who claim a lawful right. Let them swear by Allah (saying): "We affirm that our testimony is truer than that of both of them, and that we have not trespassed (the truth), for then indeed we should be of the wrong-doers."

(5:107) But then, if it is afterwards ascertained that both of them merit (the suspicion of) sin, let two others take their place of those nearly concerned, and let them swear by Allah, (saying): Verily our testimony is truer than their testimony and we have not transgressed (the bounds of duty), for them indeed we should be of the evil-doers.

(5:107) Yet, in case it be discovered that both of them have truly merited (the accusation of) vice, then two others shall rise up in place (Literally: in both their stations) of the ones nearest of the most concerned, (Literally: truly merit the right to witness, or near kinship, or who claim a lawful right) then they both shall swear by Allah, "Indeed our testimony is truer than their testimony, and in no way have we transgressed, (for), surely in that case we are indeed of the unjust (people)."

(5:107) Then if it is discovered later that the two (witnesses) have been guilty of (that very) sin (of not giving true testimony), then have two others stand in their place from among those (rightful heirs of the deceased) whom the first two have deprived of their right, and these shall swear by God: "Our testimony is truer than the testimony of the other two, and we have not exceeded the bounds (of what is right, nor violated the rights of any others), for then we would indeed be among the wrongdoers."

(5:107) But if it be discovered that these two have become guilty of sin, then let two others stand in their place from among those (heirs) against whom the (former) two (witnesses) who were in a better position (to give true evidence) are sinfully deposed, and the two (latter witnesses) swear by Allâh (saying), `Surely, our testimony is truer than the testimony of those two and we have not exceeded the bounds of justice (in bearing the evidence) for, in that case, we shall certainly be of the wrongdoers.´

(5:107) So if (it) was stumbled upon (found) on that they (B) deserved (B) (committed) a sin/crime, so two others they (B) stay in their (B)`s place/position from those who deserved on them the first two, so they (B) swear/make oath with God (that) "Our testimony/certification (is) more worthy/deserving from (than) their (B)`s testimony/certification, and we did not transgress/violate/break, (and if we did) that we (are) then from (E) the unjust/oppressors (P)."

(5:107) If it transpires they have concealed the truth, two of those who are immediately concerned should take their place and swear by God: "Our testimony is truer than theirs. We have stated no more (than the truth), or else we shall be unjust"

(5:107) O you who believe, call to witness between you, when death draws nigh to one of you, at the time of making the will, two just persons from among you, or two others from among others than you, if you are travelling in the land and the calamity of death befalls you. You should detain them after the prayer. Then if you doubt (them), they shall both swear by Allah (saying): We will not take for it a price, though there be a relative nor will We hide the testimony of Allah, for then certainly We shall be sinners.

(5:107) If their honesty is challenged, two others from the relatives of the deceased should swear in the same way and testify to the bequest saying, "We swear by God that our testimony is the true one. We do not transgress in the matter lest we become unjust ones."
